Terms of Service

1. About these terms

These Terms of Service govern your purchase and use of Everend Forge Suite, a desktop authoring application for worldbuilding, branching narratives, and structured project documentation. Everend Forge is operated by Heinz DuBois Vera (“we”, “us”, or “Everend Forge”). Questions about these terms can be sent to heinzdubois@gmail.com.

By purchasing, downloading, installing, or using Everend Forge Suite, you agree to these terms. If you do not agree, do not use the product.

2. The product and delivery

Everend Forge Suite is currently offered as a perpetual desktop software license. The product is delivered digitally through Lemon Squeezy and the Everend Forge download page. Lemon Squeezy acts as the merchant of record for the checkout, payment processing, applicable taxes, receipts, and license delivery.

The current early-adopter offer is described on the product checkout page. Product features, supported operating systems, and technical requirements may change as the beta product develops.

3. Open-source standalone applications and the Suite

WorldNotion, PathBranching, and Compendium are also available as separate standalone applications. Their source repositories are public and their code is licensed under MIT OR Apache-2.0, unless a particular file states otherwise. Those open-source licenses apply to the standalone applications and to the corresponding open-source components included in a Suite build.

The commercial Everend Forge Suite is a separate bundled product. The Suite may include proprietary integration, orchestration, packaging, activation, update, branding, and other original Suite-specific code. The purchase of a Suite license does not make the standalone applications proprietary and does not remove any rights granted by their open-source licenses.

If you use or redistribute an open-source standalone application or component, the applicable upstream license, copyright notices, and attribution requirements govern that component. Everend Forge names, logos, and trademarks are not granted for unrelated products or redistributions except as reasonably necessary to identify the original software.

4. License grant for the commercial Suite

After successful payment, we grant you a personal, non-exclusive, non-transferable license to install and use the purchased version of Everend Forge Suite for your own creative work. The current product description permits activation on up to three devices for the same license holder.

You may not resell, sublicense, rent, redistribute, publish, or share your license key; provide the software as a hosted service; or remove licensing and attribution notices. You may not use the software for unlawful activity or attempt to bypass its technical protections.

5. Your content

You retain ownership of the stories, notes, worlds, characters, and other material you create or import into Everend Forge. The application is designed around local project files. We do not claim ownership of your creative content.

You are responsible for maintaining backups of your projects and for ensuring that any imported material is yours to use. If you contact us for support, only share project material that you are comfortable disclosing.

6. Updates and beta status

Everend Forge is currently in beta. We may release bug fixes, improvements, updates, or changes to the product at our discretion. A perpetual license covers the purchased product version and updates that we choose to provide; it does not promise unlimited future features, a fixed release schedule, or permanent compatibility with every future operating system.

7. Support

We provide reasonable product support by email at heinzdubois@gmail.com. Support response times are not guaranteed, but we will make reasonable efforts to help with installation, activation, and reproducible product issues.

8. Intellectual property

Everend Forge Suite, including its software, branding, design, documentation, and original assets, belongs to Everend Forge or its licensors. These terms grant a license to use the product; they do not transfer ownership of the product or its intellectual property to you.

9. Disclaimer and limitation of liability

To the extent permitted by law, Everend Forge Suite is provided on an “as available” and “as is” basis. We do not guarantee that the software will be uninterrupted, error-free, or compatible with every device or workflow. You should keep backups of important projects.

To the extent permitted by law, Everend Forge will not be liable for indirect, incidental, special, consequential, or loss-of-data damages arising from use of the product. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded.

10. Suspension and termination

We may suspend a license or access to downloads if we reasonably believe that a license key is being shared, resold, fraudulently obtained, or used in violation of these terms. If your license is terminated for a material breach, you must stop using the software and remove copies that you are not entitled to keep.

11. Changes to these terms

We may update these terms when the product or legal requirements change. The latest version will be posted on this page with a revised date. Changes will not remove rights that have already accrued under applicable law.

12. Governing law

These terms are governed by the laws applicable in Peru, except where mandatory consumer protection law provides otherwise. Any dispute should first be raised with us at heinzdubois@gmail.com so we can try to resolve it directly.

La compra concede una licencia personal y no transferible para usar el paquete comercial en hasta tres equipos del mismo titular. WorldNotion, PathBranching y Compendium también existen como aplicaciones independientes de código abierto bajo sus propias licencias MIT o Apache-2.0; la compra de la Suite no cambia esas licencias.
